Terms and Conditions for Interstate Transport 

1. Definitions

  • Service Provider: Refers to Haych express, offering transport services.
  • Customer: Refers to the individual or business contracting the service.
  • Goods: Refers to items being transported, including caravans, trailers, forklifts, bobcats, excavators, and other loads up to 12 tons.

2. Service Scope

  • We provide interstate transport services for mid-sized loads up to 12 tons between Victoria, New South Wales, and Queensland.

3. Booking, Deposits, and Payments

  • A 30% deposit is required upon booking to secure the transport service.
  • The remaining balance must be paid prior to the shipment, unless otherwise agreed.
  • Any additional costs incurred due to delays, access issues, or unforeseen changes will be the responsibility of the customer.

4. Customer Obligations

  • The customer must ensure that all goods are properly prepared and secured for transport.
  • Accurate descriptions of the load, including weight (up to 12 tons), dimensions, and handling requirements, must be provided.
  • The customer is responsible for ensuring access at both the pick-up and delivery points.

5. Transport and Delivery

  • The service provider will make every effort to transport goods within the agreed timeframe. However, delays caused by weather, road conditions, or other unforeseen circumstances are not the responsibility of the service provider.
  • Delivery dates and times are estimates and may be subject to change.

6. Insurance and Liability

  • Goods are transported at the customer's risk unless additional insurance is arranged. The service provider does not provide coverage for loss or damage unless specifically requested and agreed upon.
  • The service provider is not liable for damages caused by poor packing, incorrect information provided by the customer, or pre-existing damage to the goods.

7. Damage and Claims

  • Any damage to goods must be reported within 24 hours of delivery.
  • The service provider is not responsible for damages resulting from third-party actions or circumstances beyond reasonable control, such as traffic incidents or natural disasters.

8. Limitation of Liability

  • To the fullest extent permitted by law, the service provider’s liability for any loss or damage is limited to the transport charges paid by the customer.
  • The service provider is not liable for indirect, incidental, or consequential damages.

9. Cancellation, Refunds, and Deposits

  • Cancellations must be made at least 48 hours before the scheduled transport. Failure to cancel in this timeframe may incur a cancellation fee.
  • The 30% deposit is non-refundable unless the cancellation is made within 48 hours prior to the service.
  • No refunds will be provided for services already rendered.

10. Legal Compliance

  • The service provider operates in accordance with Australian transport laws, including the Heavy Vehicle National Law (HVNL), applicable to vehicles up to 12 tons, and Chain of Responsibility (CoR) regulations.
  • Both the service provider and the customer must comply with all state and local regulations regarding the transport of heavy goods up to 12 tons.

11. Dispute Resolution

  • Any disputes must be resolved through negotiation between the service provider and customer. If unresolved, disputes may be referred to mediation or arbitration in accordance with Australian law.

12. Governing Law

  • These terms are governed by the laws of the state where the service was contracted (Victoria, New South Wales, or Queensland).

Legal Considerations for Heavy Vehicle Transport (Up to 12 Tons)

  • Heavy Vehicle National Law (HVNL): Regulates vehicles over 4.5 tonnes, including your 12-ton capacity. This law governs vehicle safety standards, driver fatigue management, mass, dimension, and load restraint requirements.
  • Chain of Responsibility (CoR): All parties involved in the transport process, including loaders, schedulers, and customers, are responsible for compliance with heavy vehicle regulations to ensure road safety and legal adherence.
